Множинність втілень моделі модерної держави: філософське осмислення юридичних колізій

Актуальність. Виявлено, що удосконалення держави на засадах її раціональної модернізації не лише зберігає свою суспільну актуальність, але й набуває нової наукової значущості. Уточнено, що модерна держава є одним з найбільш впливових здобутків соціальної модернізації, але водночас вона є також потужним засобом посилення наступних модернізаційних змін суспільства. Метою цієї статті є прояснення філософських підстав для зняття юридичних колізій у типології модерних держав. Методи. У якості класичних філософських теорій модернізації, які можна застосувати для побудови моделі модерної держави, розглянуто підходи Карла Маркса, Еміля Дюркгайма та Макса Вебера, які мали базову юридичну освіту і надавали правовим чинникам першорядної значущості у побудові суспільного ладу. Звернення до концепції множинної ідентичності Шмоеля Ейзенштадта відкрило перспективу врахування множинних шляхів досягнення функціональних завдань модерної держави. Використання системних соціальних теорій Талкота Парсонса та Нікласа Лумана показало взаємозв’язок основних функцій модерної держави. Неоінституціональний підхід надав можливість простежити конкретні організаційні втілення модерної держави у режимі соціологічного просвітництва. Новизна. З’ясовано, що правове прояснення можливостей функціонального удосконалення кожної модерної держави відкриває перспективи не лише зняття суперечностей у трактуванні правових норм фахівцями-юристами, але й є важливою складовою демократичної освіти кожного її громадянина. Висновки. Наголошено на раціональних засадах легітимації модерної держави, яка полягає у раціоналізації політики і правовому обґрунтуванні державності. Розглянуто філософські та освітні підстави раціональної легітимації національних історичних втілень модерної держави.
